Any person engaging in any skating activity shall assume and shall be solely responsible for any property damage and/or any personal injury to himself or herself or to any third parties which arises out of any skating activity, including, but not limited to, any property damaged at the University. Moreover, any person choosing to engage in any skating activity of any kind or nature shall assume all risks associated with such activity.

Notwithstanding any other provision of this policy, any type of skating is absolutely prohibited in the following areas:

There will be no impound fee.
  • For a second offense, within twenty-four months of any previous offense or warning, any skateboard involved in such a violation shall be impounded for not less than forty-eight hours and any person engaging in skating activity which violates this policy shall be subject to a fine of not less than ten dollars plus applicable impound fee.
  • For a third or subsequent offense, within twenty-four months of any of the previous two offenses, any skateboard involved in such violation shall be impounded for not less than thirty days and any person engaging in skating activity which violates this policy shall be subject to a fine of not less than thirty dollars plus applicable impound fee.
  • Impounded skateboards shall be held by the UAPD and released only during regular business hours to individuals with satisfactory identification. Payment of a ten-dollar storage fee will also be required for release, except as provided in (a) of this subsection.

Skateboards impounded under this section which are unclaimed sixty consecutive days after the applicable minimum impoundment time period has elapsed will be presumed abandoned and be subject to sale.

The University and its officers, agents, and employees shall not be liable for loss or damage of any kind resulting from impounding, storage, or sale of any item under this policy.

Impoundment or sale of any skateboard under this policy shall not release any person from liability for damage to persons or property caused by the use of any in-line skates, roller skates, skateboards, or other similar equipment on campus or other property owned or controlled by the University.

Any person subject to any of the enforcement sanctions provided herein shall have the right to file an administrative appeal with the UAF Parking and Traffic Appeals Court at the Transit and Parking Department in accordance with the procedures set forth in the University of Arkansas, Fayetteville's Parking and Traffic Regulations.
